A deposition is a formal process in which a witness is asked questions under oath by attorneys from both sides, outside of a courtroom, with a court reporter present to create a written transcript. Depositions are a standard part of the discovery process in serious injury litigation.

In most catastrophic injury cases, the injured person will be deposed by the defense attorneys at some point during litigation.
